Obiettivi formativi

Fundamental Rights in Europe is a key argument of the europeanization and globalization of the institutions of public law at all levels of government that requests specific legal knowledge and methodology. The theories and practices of Fundamental Rights have to be analysed in order to enable students  

- to discuss and implement the various legal philosophies and cultures feeding the controversies on fundamental rights in an open society,

- to analyse the questions of general theory of the law related to fundamental rights in Europe,

- to make systematic interpretation of the various sources of law regarding fundamental rights,

- to apply all tools offered by jurisdictional, administrative and political guarantees, including human rights watching, within the various legal orders operating in Europe

Risultati dell'apprendimento attesi

By the end of the course students should have an overall awareness of the multilevel protection of human rights  in Europe and should be able to prospect and argue solutions for specific fundamental rights cases.

Oral exam has to be given in English or French or German and will focus specific questions related to the lessons (attending students) or lectures (non attending students). On demand, final exam for attending students can consist of a discussion of a short written comment on a Court's decision assigned by the teacher (either in English or in French or in German language).

The first part of the course deals with theoretical and general issues, the last part will focus practical aspects and case studies.

GENERAL PART

1. The concept of Fundamental Rights in EU and public comparative law

2. The history of Fundamental Rights and Duties

3. Philosophical and legal theories of Fundamental Rights

4. The international, EU- and national sources of Fundamental Rights

5. The personal scope of Fundamental Rights

6. The categories of interests protected by Fundamental Rights

7. Subjects bound by Fundamental Rights

8. Concretization and Limitations of Fundamental Rights

9. The protection of Fundamental rights through national judges

10. The protection of Fundamental Rights through independent administrations

11. The protection of Fundamental Rights through national political bodies

12. The protection of Fundamental Rights through constitutional judges

13. Institutions of protection within the Council of Europe

14. Institutions of protection within the European Union

15. Institutions of protection at UN-level

CASE STUDIES

Selected cases of ECHR, ECJ or national constitutional courts.
