Obiettivi formativi

This course offers a systematic analysis of the European legal institutions for the protection of creativity, innovation and access to knowledge in the context of a global “information society”. The main objective of the course is to provide postgraduate students with solid knolwedge of current key European legislation and jurisprudence on intellectual property law, as well as with critical understanding of the policy challenges ahead.

Having completed the course, students are expected to

  1. Demonstrate knowledge of key legal issues of the European harmonisation in the area of intellectual property rights.
  2. Demonstrate critical understanding on the role and limits of intellectual property rights for the protection of creativity and innovation in the EU internal Market and in the global knowledge economy.
  3. Demonstrate essential practical knowledge on how to apply for registered intellectual property rights in the EU.
  4. Demonstrate an ability to apply key notions of European integration to legal and policy issues arising from the management of intellectual property rights in the knowledge economy.
  5. Demonstrate an ability to ascertain the substantial European law from legislation, case law and secondary literature, as applied to intellectual property law.
  6. Demonstrate an ability to critically evaluate current legal issues and future scenarios of European harmonisation of intellectual property rights.
  7. Apply substantial law to cases relating to intellectual property law in the European context.
  8. Demonstrate an ability to present relevant knowledge and understanding of legal problems of intellectual property in the information society in the form of reasoned and supported argument.
  9. Demonstrate an ability to present cogent written and oral arguments to analyse legal issues of intellectual property law in the European context.
  10. Demonstrate an ability to find relevant primary and secondary material for research from hard copy and electronic sources.

Frontal lectures and seminars. Master classes with experts will also be part of the programme.

Modalità di verifica dell'apprendimento

The evaluation consists in written and oral examination.

The written exam is recommended to attending students only. It will consist in a 2-hours closed-book examination. Students will have to respond 3 out of 4 open questions within a 500-word limit each. The questions, covering the whole range of topics discussed in class, may consist in scenario problem-solving, discussion of theoretical issues, or a combination of both.

The oral exam is optional for students who passed the written examination. Students will have to respond questions covering all parts of the programme. For non-attending students, the exam will be based on the relevant parts of the textbook, as indicated in Moodle.

For the purpose of the evaluation, the following criteria will be taken in consideration in both the written and oral examinations:

- Adequate identification of the relevant legislation and jurisprudence (where applicable)

- Completeness of the answer

- Use of an appropriate legal terminology
