Obiettivi formativi
Recent developments in the international society are challenging the multilateral rules of international trade and the international investment regime - two key areas of international economic law - as they were developed in the decades after the II World War. The aim of this course is to provide students with an overview of the institutional and substantive aspects characterizing the two areas, and with the conceptual tools necessary to critically analyze them in light of new challenges and issues.

Students are expected to possess adequate knowledge of the institutional and substantive components of the international rules on trade and investment activities worldwide. They are expected to convey them in a precise and effective way. They are also expected to understand the main current challenges to the two systems through critical discussion.

Programma
The programme covers two main areas of international economic law: international investment law and international trade law.
After a general introduction on the evolution of the international legal frameworks for trade and foreign investment activities, the two parts of the programme will be addressed separately. However, differences and synergies between these two strands of international economic regulation will be constantly outlined and discussed.
The part of the programme addressing international investment law covers:
- the evolution of the international system of investment protection;- sources of investment law; - definitions of investors and investments; - standards of investment treatment (including non-discrimination, expropriation, fair and equitable treatment); - exceptions and carve-outs; - means of solving controversies.
The part of the programme on international trade law will deal with:
- the history, economics and institutional aspects of the World Trade Organization (WTO); - its main substantive disciplines (border measures; non discrimination; exceptions); - the WTO dispute settlement system; - regional trade agreements.

The two teaching blocks will be organised through a blend of different components: live sessions, reading and study materials, exercises.
All the materials will be made available through the teaching platform (Moodle).
It is essential and compulsory that all the students enrol in the teaching platform to have full access both to materials, discussions and communications.

Modalità di verifica dell'apprendimento
Oral exam consisting of four open-ended questions (2 for each part of the programme). Answers will be graded on the basis of completeness and accuracy of information, as well as of the capacity to use specific legal terminology. Upon each student's choice, one of the two parts may be evaluated through submission of a case study or an essay (topics to be agreed in advance with the teacher) by the end of the course - 13 December 2024.
