The Seminar is framed within the general objective of the First Cycle Degree Programme of "Global Law and Transnational Legal Studies"  to give the students the possibility to deepen the research of different legal models, practices and cultures, in the specific field of family and succession law.

At the end of the seminar, students will have a basic knowledge of the main legal issues related to international families. By the end of the seminar, students will have acquired the ability to understand the tools of private international law and to handle cases of medium complexity.

The Seminar is part of the ‘Jean Monnet Chair CLOSER - Cross-border famiLies, family reunifications and Succession mattERs’, held by Prof. Ilaria Riva, co-funded by the EU Erasmus+ Programme. Two lecture series are planned on the following main topics: :

  1. Family, family models and migrations
  2. Cross-Border Families: current challenges

The seminar will be focused on cross-border family and succession law. First, different models of matrimonial Property Regimes across Europe will be analysed, as well as different rules regarding the fundamental issues of inheritance, including intestacy, the freedom to dispose of assets in the event of death, and the protection of relatives of the deceased (forced heirship). Next, the seminar will focus on issues of private international law, such as EU rules on the property regimes of international couples (EU Regulations n. 2016/1103 and 1104); EU rules on cross border successions (EU Regulations n. 2012/650); the role of Habitual Residence as a Personal Connecting Factor in Private International Law; the Public Policy Exception in Families and Successions Regulation; the choice of-law agreements.

The seminar will be held on the FIRST semester, every Tuersday,  h. 2:00-4:00 pm, starting from 30 September in room LL3.
