Basic knowledge of the most important contemporary legal systems and of the fundamental terms and concepts of constitutional law and private law (eg form of government, form of state, constitutional justice, contract, property, marriage). There are no prerequisites for this teaching, but the students could follow it more profitably having already passed (or at least followed) the course of comparative law. The teacher may indicate short supplementary reading to the students who have not acquired this knowledge by attending such a course. No prior knowledge of Chinese history and culture is required.

At the end of the course, the students should have acquired a general understanding of the evolution of Chinese law, and be able to critically analyze its main features, including case law.

Programma

The course introduces the study of Chinese law and legal culture and provides an overview of contemporary methodologies and reasearch approaches. It will cover matters ranging from historical transformations to most recent developments of the Chinese legal system and contextualize the discussed issues witin China's economic, social, cultural and political settings. Specific topics will be inter alia Chinese legal pilosophy and traditional law, legal transfer and the transformation of law in the 20th Century, PRC's legal history and approaches to the rule of law, current legal issues of China's public and private law as well as international legal dimensions of China's legal development

Modalità di insegnamento

Lectures (40 hours - 6 CFU) with the support of powerpoint presentations. The slides of the lessons and the related materials will be uploaded to the Moodle platform in advance, in orderd to allow the students to prepare themselves on the topic that will be discussed during the class

Modalità di verifica dell'apprendimento

Written examination (only for students who attend the lectures). The written examination will be structured in three open questions, each of which will be assigned a maximum of 10 points. All the other students will give the exam in oral form. The evaluation will be expressed in a 30-points scale. The exam will assess the students' acquired knowledge, and their ability to deal with a topic in a critical and logically organized way and in a proper language. For students attending the course, class participation shall account on the overall grade.
