Obiettivi formativi
The course is designed for students interested in civil and commercial law within an international context, covering all important aspects of cross-border cases dealt with in national courts.
Students will explore the significant challenges related to resolving international disputes both within and outside the European Judicial Area.

- be able to recognize, examine, and resolve conflict-of-law dilemmas that emerge in transnational commercial disputes.

Key points covered by the course:
- Advantages and disadvantages of court litigation;
- Private financing of ADR/litigation (contingency fees; third party funding; litigation crowfunding);
- Jurisdiction of EU national courts (in cross-border cases) including choice of court agreements/Forum shopping. Special focus on Climate change litigation;
- Service of process abroad;
- Obtaining evidence abroad (outside and within the EU);
- Actual or potential relationship with other legal proceedings in the same or similar claim (e. g. forum non conveniens, anti-suit injunctions, lis alibi pendens);
- Transnational provisional relief;
- Recognition and enforcement of foreign countries judgments.

Modalità di insegnamento
Class will be held in person, and the schedule will be shared via Moodle. Students are kindly asked to register themselves on Moodle. The teaching method aims to foster active student involvement. Specifically, students will be encouraged to present key cases in class, analyse and solve practical problems, and deliver presentations on significant legal cases. Through this approach, students will experience the crucial stages of managing cross-border disputes, stepping into the role of legal counsel for one of the parties in transnational litigation.
Students may also choose to follow the course in blended mode, creating educational materials such as cartoons or podcasts either individually or in groups of up to three students. Topics for these materials will be assigned in advance via Moodle, where students can also sign up for them.
WARNING: All students - on-campus students (1), blended-learning students (2) and self-learning students (3) - are required to prepare for the exam using the handbook written by the course instructors. The handbook contains self-assessment tests and case studies designed specifically for independent study. The reference is: D'Alessandro and Castagno, Handbook on Cross-Border Litigation, Wolters Kluwer, 2024.

The grading for the class will be determined as follows:
A) On-campus Students:
1. Class participation and in class presentations: 50% (= up to 15 points);
2. Written examination in person (a case-study to solve. Time allowed: 30 min): 50% (= up to 15 points plus honors);
B) Blended-learning Students:
1.Quality and originality of the submitted work: 50% (= up to 15 points);
2.Written examination in person (a case-study to solve. Time allowed: 30 minutes): 50% (= up to 15 points plus honors);
C) Self-learning Students:
Written examination in person (Time allowed: 35 minutes) consisting of:
1. 5 multiple-choice questions (based on the Handbook's self-assessment tests): 50 % (= up to 15 points);
2. a case-study to solve: 50% (= up to 15 points plus honors).
EXAMS WILL BE HELD IN PERSON ONLY.
