The course is designed for students interested in civil and commercial law within an international context, covering all important aspects of cross-border cases dealt with in national courts.
Students will explore the significant challenges related to resolving international disputes both within and outside the European Judicial Area.

By the conclusion of the course, students will:
- be able to recognize, examine, and resolve conflict-of-law dilemmas that emerge in transnational commercial disputes.
- possess the skills to analyze, compare, and assess the legal regulations implemented by courts in Europe and internationally to tackle these concerns.

- Advantages and disadvantages of court litigation;
- Private financing of ADR/litigation (contingency fees; third party funding; litigation crowfunding);
- Jurisdiction of EU national courts (in cross-border cases) including choice of court agreements/Forum shopping. Special focus on Climate change litigation;
- Service of process abroad;
- Obtaining evidence abroad (outside and within the EU);
- Actual or potential relationship with other legal proceedings in the same or similar claim (e. g. forum non conveniens, anti-suit injunctions, lis alibi pendens);
- Transnational provisional relief;
- Recognition and enforcement of foreign countries judgments.

Modalità di insegnamento
Class will be held in person, and the schedule will be shared via Moodle. Students are kindly asked to register themselves on Moodle.
The teaching method aims to foster active student involvement. Specifically, students will be prompted to partake in presenting key cases, analyzing and solving practical cases, and delivering presentations on significant legal cases. Through this approach, students will go through crucial stages in managing cross-border disputes, stepping into the role of legal counsel for one of the parties in a transnational litigation.
Students unable to attend in-person classes ("students not attending classes") can prepare for the exam using a forthcoming Handbook authored by the course instructors. The Handbook features self-assessment tests and case studies designed for independent study. Reference can be made to D'Alessandro, Castagno, Handbook on Cross-Border Litigation, Wolters Kluwer, 2024.

The grading for the class will be determined as follows:
A) For students attending classes in person:
Class participation: 50%;
Written examination in person (a case-study to solve. Time allowed: 30 min): 50%;
B) For students attending the course in self-learning mode ("students not attending classes"):
Written examination in person (5 multiple-choice questions - modeled on the self-assessment tests - plus a short case-study to solve. Time allowed: 35 min.): 100%.
EXAMS WILL BE HELD IN PERSON ONLY.
