Obiettivi formativi

Il corso mira a fornire o consolidare le conoscenze e le abilità elementari necessarie per compiere le seguenti operazioni:
- qualificare
- sussumere
 - definire
- classificare
- elencare
- esemplificare
- intendere e produrre regole (la regola è un’informazione avente struttura “se X allora Y”)
- argomentare (l’argomentare è l’operazione del discorso che consiste nel sostenere o respingere una tesi avvalendosi di altre informazioni, dette argomenti).

 

The course aims to provide or consolidate the student’s knowledge and elementary skills, needed to:
- qualify
- subsume
- define
- classify
- list
- exemplify
- understand and make rules (the rule is an information with this structure: “if X then Y”)
- make an argumentative speech (to argue means defending or attacking a thesis using other elements, called arguments).

Risultati dell'apprendimento attesi

La formazione del Corso é orientata in direzione  dei seguenti risultati di apprendimento:
- conoscenza di base circa le funzionalità illocutorie (descrittive, direttive, costitutive) e perlocutorie del discorso;
- conoscenza e controllo di un lessico istituzionale, e di basi teoriche elementari, aventi ad oggetto l'articolazione complessiva e le specificità delle principali operazioni di discorso rilevanti al fine di un sapere rigoroso;
- sensibilità attenzionali nei confronti della dimensione semantica e pragmatica entro i processi di acquisizione e comunicazione del sapere (comune e, segnatamente, giuridico);
- sensibilità alle esigenze di acquisire e affinare abilità nell'intendere e nel produrre enunciazioni tecniche;
- abilità nell'intendere enunciati caratterizzati da valenze metodologiche essenziali e ricorrenti;
- abilità nel produrre enunciati contenutisticamente attendibili, linguisticamente corretti, comunicativamente chiari ed efficaci;
- abilità nell'intendere strutture e funzionalità della regola, nonché nel produrne formulazioni adeguate sotto un profilo funzionale e comunicazionale.

The course aims to provide the following learning results:
- basic knowledge of the functional illocutionary characters (descriptive, directive, constitutive) and of the functional perlocutionart characters of the discourse;
- knowledge and control both of institutional language and of basic theoretical foundations in order to the general articulation and to the specificities of the most important language operations needed to give rise to an accurate learning;
- attentional focalization with respect to semantic and pragmatic perspectives within acquisitional and communicational processses of the everyday, and chiefly, legal knowledge;
- sensibility with respect to the goal to acquire and to improve skills in order to understand and to give rise to technical enunciative propositions;
- skills in order to understand enunciative propositions that are characterized by fundamental and recurring methodological significances;
- skills in order to give rise to reliable relating to the subject matter, linguistically accurate, communicatively clear and telling enunciative propositions;
- skills in order to understand frames and fundamental characters of the rule as well as skills in order to give rise to appropriate wordings of the same with specific regard to the functional and communicational side.

Modalità di insegnamento

L'insegnamento avrà luogo in cinque lezioni frontali, con verifiche intermedie su quanto acquisito, con partecipazione attiva della classe.

 

The lessons are composed of five taught class, with intermediate checkings of the attainments, demanding an effective partecipation of the class.

Modalità di verifica dell'apprendimento

Dall'anno accademico 2015 - 2016 i risultati dell'apprendimento verranno verificati in esclusiva mediante il ricorso a periodiche prove scritte.
Le prove scritte, della durata di sessanta minuti, richiedono di:
- definire tre termini attinenti al lessico comune o giuridico;
- formulare tre classificazioni con indicazione dei rispettivi criteri distintivi;
- formulare esempi, o contesti d'uso, relativi a termini chiave afferenti al corso, oppure al lessico giuridico istituzionale;
- intendere regole enunciate in forma comune e “tradurle” in forma canonica (“se X allora Y”);
- interpretare un enunciato suscettibile di più tesi e formulare un argomentazione a sostegno della tesi prescelta.
I termini da definire, gli insiemi da sottoporre a classificazione, i termini chiave, le regole da tradurre in forma canonica, l'enunciato da interpretare e su cui svolgere l'argomentazione sono indicati, di volta in volta, nel modello distribuito ai candidati all'inizio della prova.
Il superamento della prova dà luogo all’acquisizione di tre crediti.

Norma transitoria: Gli studenti che, allo stato, abbiano conseguito due, o più, esiti negativi in precedenti verifiche verranno tempestivamente avvisati, sul Sito di Dipartimento, delle modalità di effettuazione dei loro successivi Esami.

From the academical year 2015 - 2016 the requested outcomes will be verified only through periodical written exams of sixty minutes.
The test requires:
- to define three words that concern everyday language legal terms;
- to formulate three classifications, with their respective distinguishing criteria;
- to formulate examples, or frameworks based on usage, of key terms analyzed during the course or of basic legal terms;
- to understand rules in common form and to “translate” it into the canonical form ("if X then Y");
- to explain an enunciative proposition and to argue supporting the chosen out thesis.

The terms to define, the sets to classify, the key terms, the rules to "translate" in canonical forms, the enunciative proposition to interpret and, by means of which, to argue, are each time pointed out to the candidates into the form distributed at the beginning of the test.

Transitional provision: The students that have attained two, or more, failed exams in preceding tests will be, at the right time, noticed with regard to the formality of accomplishment of their following tests.

Programma

Il programma prevede la trattazione delle tematiche seguenti: la qualificazione, la sussunzione, la definizione, la classificazione, l'elenco, l'esempio, la regola, l'argomentazione (ovvero sostenere o respingere una tesi avvalendosi di altre informazioni, dette argomenti) .
L'ordine espositivo, per agevolare la trattazione e la memorizzazione, farà riferimento ad uno schema topico ricorrente (identificazione della tematica, profili strutturali, modalità di formulazione, eccetera). Qui di seguito, tale schema é esemplificato in riferimento alle qualificazioni: "cosa é la qualificazione"; "come sono strutturate le qualificazioni"; "come sono formulate la qualificazioni"; "come possono essere le qualificazioni"; "come devono essere le qualificazioni"; quali sono gli errori più gravi nelle qualificazioni"; "a cosa servono le qualificazioni".

 

The course provides for the treatment of the following items: qualifications, subsumptions, definitions, classifications, listings, examples, rules, make an argumentative speech (to argue means defending or attacking a thesis using other elements, called arguments).
The expository arrangement of the items will make reference to a recurring topical scheme to facilitate treatment and memorization (item identification, structural sides, necessary formalities of wording, and so forth). This scheme is here illustrate by the pertinent topic as regards to the qualifications: "what qualifications are"; "how qualifications are framed"; "how qualifications are worded"; "how qualfications may be"; "how qualifications must be"; "which are the harmful errors as regards qualifications that we know"; "what qualifications are for".
