 Seminarial course aiming at providing the basic knowledge of the foundations of international arbitration

Students will experience some of the most important concepts and steps in international arbitration also by case studies and role playing

The different teaching blocks will be organised through a blend of different components:  reading and study materials, video lectures, presentations with vocal comment, streaming lessons, virtual room  (Webex) sessions for interaction with students, assignments of reaction papers, students’ presentations etc.

All the materials will be made available  through the teaching platform (moodle)

The course will start on February 25 th at 8.45 with a live presentation of its articulation on the Webex virtual room https://unito.webex.com/meet/alberto.oddenino
   

A more precise schedule of the course and its articulation in blocks will be made available on the moodle platform of the course before the commencement of the lessons .

It is therefore essential that all the students enrol in the Moodle platform to have full access both to materials, discussions and communications

Programma

Arbitration has become the default dispute resolution mechanism for commercial transnational disputes.

The course will introduce students to the basics of the mechanism, dealing with its theoretical foundation and its practical application.

The course is organised in 6 Blocks:

1. Introdution to international arbitration (definition, advantages, sources)

2. The arbitration agreement ( validity, effects, main elements)

3. The arbitral tribunal ( composition, issues of independence)

4. The arbitral proceedings (main elements, issues of due process)

5. The issue of arbitrability and the role of mandatory rules and public policy issues

6. The award, its setting aside and its international enforcement
