Obiettivi formativi

Il corso intende mettere il diritto italiano in relazione all'esperienza di altri ordinamenti, mostrando come un patrimonio culturale comune si sia differenziato in Europa e come ordinamenti lontani abbiano organizzato la convivenza civile secondo schemi differenti da quelli familiari allo studente nei primi anni di formazione giuridica.

The course is meant to introduce students to foreign legal systems showing how a common cultural background has  been over time diversified in Europe. The effort is also to alert students to the fact that  schemes of social organization are possible that follow different paths from those that the students have explored at the beginning of their legal studies.

Risultati dell'apprendimento attesi

Alla fine del corso gli studenti devono avere consapevolezza del fatto che la convivenza civile e il bilanciamento degli interessi individuali possono esser organizzati attraverso meccanismi di controllo di diversa natura, non necessariamente modellati sullo schema del diritto romano.

Gli studenti sono indotti a confrontare le regole che governano le società e che (nell'esperienza occidentale) sono  garantite dallo Stato senza fermarsi alla sola lettera della legge scritta. Un confronto costruttivo deve contemplare altri formanti:

- la casistica giurisprudenziale

- la letteratura giuridica.

Lo studente deve aver compreso come il diritto sia soggetto a contagi attraverso le frontiere, all'ottica concentrata sul diritto interno si deve sostituire  la sensibilità ai prestiti culturali, la percezione dei fattori che inducono alla circolazione dei modelli giuridici.

 

By the end of their classes the students should be aware of the fact that the citizens' co-existence and the balancing of their interests may be reached following models that differ from the Roman heritage.

Students should be conscious of how the law is vulnerable to contamination across borders. The focus on the domestic law should be replaced by a capacity to identify cutural borrowings, and the elements causing imitation should be identified.

Students are encouraged to compare rules governing society (and enforced by the State in the  Western experience) without stopping at the mere words of legal instruments. In order to gather a a more thourough understanding, other elements (legal formants) are to be taken into account, notably:

- the courts' case-law

- the legal literature.

By the end of their classes the students  should be aware of how the law has been cross-fertilized across borders. A deep perception of the extent of cultural borrowings should be reached, the mechanisms prompting the imitation of legal solutions should be taken into account.

Modalità di insegnamento

Il corso è insegnato in modo tradizionale, con lezioni frontali che si avvalgono del supporto di proiezioni in cui sono rappresentati diagrammi della struttura delle corti dei diversi Stati,  pagine estratte dalle Costituzioni, immagini di protagonisti dei diversi movimenti culturali citati. Gli studenti sono sollecitati  con domande del docente a rapportare le nuove nozioni su ordinamenti stranieri a ciò che hanno già imparato per il diritto italiano o romano.

Classes are taught in the traditional style of lecturing to an audience with the support of powerpoint presentations where the diagrammes of the judiciary organisation, excerpts fron constitutional charters, images of distinguished scholars of the past are presented. Students are encouraged to express their impressions/opinions by questions asked by the lecturer in order to compare what the students have already learnt about Italy or Roman law with the new information provided about foreign legal systems.

Modalità di verifica dell'apprendimento

L'accertamento avviene, durante il corso, con un modello di  alcune domande al quale gli studenti rispondono oralmente a gruppi di 2-3 studenti: i compagni possono correggere, integrare quanto detto dai volontari che iniziano le risposte.

L'accertamento finale avviene tramite colloquio orale: a partire da una prima domanda generale, seguendo con domande più circostanziate, casualmente scelte rispetto a modelli giuridici diversi.

In order to check how the students are learning, an intermediate test will be provided, with a few questions that the students may analyze orally in groups of 3 people. The rest of the class will be able to add, correct,  improve.

The final grading will be done by an oral interview, moving from a general issue to more specific questions randomly selected from different fields and geographical areas.

Attività di supporto

I materiali utilizzati per le proiezioni in classe sono in parte caricati su Moodle: non tutti, per evitare l'apprendimento troppo elementare che identifica in brevi risposte "giuste" quanto serve per la discussione finale che si vuole invece ragionata.

Powerpoint materials used in class will be in part uploaded on Moodle: however not everything will be accessible, in order to prevent the persuasion that there are simple "correct" answers as a a developed and  motivated reply is required.

Programma

-Partiamo dalle diverse opinioni sull'utilità della comparazione per confrontare i diversi punti di vista sugli scopi che questa può avere.

-Indaghiamo sulle iniziative di uniformazione del diritto, sulle relazioni tra la comparazione e altre scienze.

-Esaminiamo le fattezze caratterizzanti del common law inglese e americano: collegando quelle attuali alle radici storiche che le hanno determinate.

- Confrontiamo questi dati con l'esperienza che ci è più familiare del civil law, attraverso anche alla sua propagazione in Africa, Medio e Estremo Oriente.  - Riflettiamo sugli esiti del periodo socialista in Est Europa e su quanto di questo lascito sopravviva in paesi che sono stati influenzati dal modello sovietico (ad es. in Cina).

- Accostiamo la tradizione islamica per identificare soprattutto le radici del diritto musulmano. Considerando lo stratificarsi di modelli diversi in Africa e le ripercussioni che la colonizzazione europea ha avuto.

- L'estremo Oriente viene considerato nella particolare luce dell'imitazione, molto filtrata, dei modelli occidentali.

The class tries to introduce the students to the major legal systems, by way of a general description of their main features. We shall consider together the process of legal transplants. We shall reflect on the method and means of comparative law.

 - We start from the reasons why we compare, the aims of such an apporach.

 - We examine efforts to harmonize the law, the relationship between the comparative method and various scientific fields.

-  We analyze the main features of the English and Nothern American common law, relating the contemporary situation with its historical roots.

- We compare these data with the civil law tradition that is more familiar to us, also considering its influence on the African, Middle and Far East experiences. We consider the consequences of the socialist experience in States that have been influenced by the Soviet model (e.g. in China).

-We approach the islamic tradition in law to identify the sources of islamic law. We take into account the consequences of the European colonies in Africa.

-The Far East is observed with special emphasis on the imitation, rather selective and contaminated, of Western legal models 

Testi consigliati e bibliografia

Oggetto:

Studenti frequentanti: A. Gambaro, R. Sacco, Sistemi giuridici comparati, Utet, Torino, 2008, pp. 442 (non saranno oggetto d’esame le pp. 111-123): precisazioni ulteriori su opzioni aperte ai frequentanti saranno fornite durante le lezioni.  La docente si servirà di proiezioni powerpoint che saranno in parte rese accessibili agli studenti per aiutarli a ripercorrere il lavoro svolto in classe. I materiali (leggi, brani di costituzioni, articoli di legislazione, estratti di sentenze, ecc.) serviranno come spunto per le lezioni: sono sollecitate le osservazioni degli studenti, sia sullo stile delle sentenze, sulla forma degli strumenti normativi, sia sui contenuti (in relazione a quanto già visto nei precedenti corsi sul diritto italiano).

In alternativa, per i soli studenti frequentanti, è proposto il testo di:

G Ajani & B. Pasa,  Diritto comparato. Casi e materiali, Giappichelli 2013. I documenti presentati nel testo devono essere studiati accuratamente, compresi i casi giudiziari.


Studenti non frequentanti: A. Gambaro, R. Sacco, Sistemi giuridici comparati, Utet, Torino, 2008, pp. 442. Anche i candidati all'esame  che non frequentano il corso devono aggiornare i dati del manuale modificati da importanti eventi recenti come riforme costituzionali, adesioni all'UE, a trattati internazionali sui diritti umani.

Students attending classes:
A. Gambaro, R. Sacco, Sistemi giuridici comparati, Utet, Torino, 2008, pp. 442 (pp. 111-123 need not to be studied). Further information on options open to students regularly attending classes will be offered during the course. The teacher will use powerpoint presentations and will give access to the slides so that students may revise the information delivered. Documents (statutes, excerpts of constitution, paragraphs of legislative acts, abstracts of judicial decisions and so on) will be used to start a discussion: active participation by students is welcomed.


As an alternative, only for students attending classes, a manual by G. Ajani, Sistemi giuridici comparati, Lezioni e materiali, Giappichelli, Torino, 2013 is available. The documents included in the book must be carefully studied, including cases.

Students non attending classes: A. Gambaro, R. Sacco, Sistemi giuridici comparati, Utet, Torino, 2008, pp. 442. Also candidates who do not attend classes must update the information of the manual with significant events such as constitutional reforms, membership to the U.E. and treaties on human rights.
