Obiettivi formativi

Fundamental Rights in Europe is a key argument of the Europeanization and Globalization of institutions of public law at all levels of government that requests specific legal knowledge and methodology. The theories and practices of Fundamental Rights have to be analysed in order to enable students  

- to discuss and implement the various legal philosophies and cultures feeding the controversies on fundamental rights in an open society,

- to analyse the questions of general theory of the law relted to fundamental rights in Europe,

- to make systematic interpretation of the various sources of law regarding fundamental rights,

- to apply all tools offered by jurisdictional, administrative and political guarantees, including human rights watching, within the various legal orders operating in Europe

 By the end of the course students should have an overall awareness of the multilevel protection of human rights  in Europe and should be able to prospect and argue solutions for specific fundamental rights cases.

Programma

The course consists of 2 modules of 20 hours each:

1st Module – Prof. J. Luther

The first module gives an introduction in concept and history, theories and sources of the Law of the Fundamental Rights in the European States and the European Union. The practice of Fundamental Rights Watching and the specific remedies for Fundamental Rights protection in National Constitutional Courts and in the European Courts of justice and of Human Rights will be highlighted. Specific new questions of freedoms, social and cultural rights and political questions will be faced.

2nd Module – Dott.ssa M. Caielli

This module analyzes specific European states’ constitutional provisions on human rights and freedoms. Particular attention will be paid to recent developments in the protection of the right to non discrimination on the basis of gender, race, religion, age, disability and sexual orientation; of welfare rights, group rights and affirmative action; of “new” rights, such as intergenerational solidarity and bioethical rights. Such fundamental rights will be examined in the light of most significant domestic constitutional case law as well as through European Court of Human Rights and European Court of Justice leading cases.

The relevant reading materials in foreign languages will be provided at the beginning of classes.

Note

Oral exam may also be given in English, French or German.

Final exam for attending students may consist of a short written comment on a Court's decision either in English, French or German.
