Obiettivi formativi

The course aims at providing the students with advanced knowledge of International Labour Law (Part I) and EU Labour Law (Part II).

In Part I, students will familiarize with the role of the ILO and of core international labour standards.

In Part II, due to the specific attention dedicated to the Court of Justice's case law, students will be able to verify the concrete impact of European Union rules on Member States.

At the end of the course students should demonstrate:

- knowledge and understanding (knowledge of the fundamental contents of International Labour Law and EU Labor Law sources and their concrete impact on national judicial systems; ability to analyse and understand relevant legal texts and judicial decisions);

- ability to apply the acquired knowledge (knowing how to apply the legislation studied to concrete cases and identify the links existing between different topics and rules);

- autonomy in intellectual production and critical judgment (e.g. ability to synthesize and organise the knowledge acquired; ability to identify key concepts; ability to understand and illustrate the problematic aspects of the regulation of certain issues in the multilevel legal order);

- communication skills (ability to use a correct legal terminology).

Modalità di insegnamento

Lessons will be in presence, in accordance with the general rules related to the COVID-19 pandemic. To attend lessons face-to-face, it is mandatory to book a seat in the classroom through the Student Booking service.

Our lessons will not be recorded but an option of remote attendance - in streaming modality on the personal Webex room of each Professor - will be granted.

The different teaching blocks will be organised through a blend of different components:

- in presence lessons;

- proposal of selected readings and class debate;

- students’ oral presentations.

Teaching materials will be made available on the Moodle platform of our course.

It is therefore essential and compulsory that all the students enrol in the Moodle platform to have full access both to materials and communications.

Students attending classes

The exam will consist of:

- Part I (International Labour Law): class presentations (20%) and oral exam (30%)

- Part II (EU Labour Law): class presentations (25%) and written exam (25%)

Not-attending students

Written exam consisting of questions on Part I (International Labour Law) and on Part II (EU Labour Law).

The Moodle page of the course is an important instrument offering support to learning activities. Therefore, the students are expected to check it on a regular basis and to take into due consideration the materials uploaded (power point presentations, readings and judicial decisions etc.).

Part I - International Labour Law (dott. Giuseppe Casale)

The lectures will deal with the following topics:

- The role of the ILO: its structure and functioning

- The evolution of international labour law: core labour standards

- Ratification and application of international labour standards

- The supervisory mechanism

- The ILO Centenary Declaration and 2030 Agenda

Part II - EU Labour Law (proff. Mariapaola Aimo, Daniela Izzi)

The lectures will deal with the following topics:

- The historical evolution of European social policy

- The sources of EU Labour Law

- Individual work relationships: more specifically anti-discrimination law and atypical job contracts.
