Oggi la fonte principale delle norme giuridiche, anche nel campo privatistico, é data dagli organi istituzionali della Unione Europea; dunque lo studente di giurisprudenza non può fare a meno di studiare tale fonte normativa
Nowadays the most important source of law, even private law, is that issued by the European Union legislative institutions; therefore the law student can not skip the study of said topic.

L'insegnamento avverrà mediante lezioni frontali; sono previste lezioni con docenti esterni. Si consiglia vivamente lo studente di munirsi del testo di MORITZ LORENZ,An Introduction to EU Competition Law fin dalle prime lezioni.
The course is taught mainly by ex cathedra lessons, though sometimes the seminar method is adopted with help of specialists. In this view the student is invited to procure possibly by the beginning of the course the text book of MORITZ LORENZ, An Introduction to EU Competition Law.

Il corso é dedicato al diritto della concorrenza nell'Unione Europea toccando in particolare i temi qui elencati:
1. L'analisi economica del diritto della concorrenza; 2. Gli antecedenti: La disciplina antitrust negli Stati Uniti - La disciplina antitrust in qualche Paese europeo; 3. Le regole antitrust nel Trattato sul Funzionamento dell'Unione Europea; Norme applicabili alle intese (art. 101); Norme applicabili alle posizioni dominanti (art. 102); Norme applicabili alle imprese pubbliche (art. 106); Norme applicabili agli aiuti degli Stati (artt. 107-109); Gli accordi di distribuzione; I diritti di proprietà industriale; Gli accordi di cooperazione; Le concentrazioni e le joint ventures; La concorrenza nei servizi; Norme di procedura e di applicazione; 4. La legge italiana n. 287/1990.
In ragione del programma svolto si consiglia al discente lo studio di questa disciplina solo dopo alcuni esami fondamentali, in particolare Istituzioni di diritto privato ed Economia politica
The course is devoted to competition law in the EU and in particular deals with the topic hereunder listed.
1. Economics analysis of competition law.
2. Some precedents. Antitrust law in the USA; antitrust rules in some European Countries (prior to the Treaty of Rome).
3. Competition principles in the Treaty for the Functioning of the European Union (TFEU).
3.1. Rules on cartels (art. 101)
3.2. Rules on dominant positions (art. 102)
3.3. Rules on public undertakings (art. 106)
3.4. Rules on States aids (arts. 107-109)
3.5. Distribution agreements
3.6. Intellectual property rights and competition
3.7. Cooperation agreements
3.8. Concentrations and joint ventures
3.9. Competition in the services sectors
3.10. Procedural and jurisdictional rules
4. Brief survey on Italian Competition Law
In consideration of the programme offered, it is highly reccommended that the student attends this course only after the passing some fundamental exams, like Private Law and Fundamentals of Economics.
