The course is tailored for students interested in civil and commercial law within a transnational context, encompassing all key aspects of cross-border cases handled in national courts.
Students will be introduced to the critical issues involved in resolving transnational disputes both outside and within the European Judicial Area

By the end of the course, students:
-will identify, investigate, and resolve conflict-of-law issues that arise in transnational commercial disputes.
- will be proficient in analyzing, comparing, and evaluating the legal rules applied by courts in Europe and outside Europe to address these matters.

The class will be conducted in person, and he timetable will be communicated via Moodle. Students are kindly requested to enroll themselves on Moodle.
The teaching approach aims to stimulate active student participation. Particularly, students will be encouraged to engage in the analysis and solution of practical cases, as well as deliver presentations on crucial legal cases. Through this method, students will experience essential steps in handling cross-border disputes, immersing themselves in the role of counsel for one of the parties involved in a transnational litigation.
For students unable to attend in-person classes ("students not attending classes"), there is an option for self-learning. In this mode, students can access self-learning materials, including case studies designed for independent study and self-assessment tests, which will be available on Moodle.

The grading for the class will be determined as follows:
A) For students attending classes in person:
Class participation: 50%;
Written examination in person (a case-study to solve. Time allowed: 30 min): 50%;
B) For students attending the course in self-learning mode ("students not attending classes"):
Written examination in person (5 multiple-choice questions - modeled on the self-assessment tests - plus a short case-study to solve. Time allowed: 35 min.): 100%.
EXAMS WILL BE HELD IN PERSON ONLY.

- Jurisdiction of EU national courts (in cross-border cases) including choice of court agreements/Forum shopping;
- Private financing of litigation (contingency fees; third party funding; litigation crowfunding);
- Climate change litigation;
- Service of process abroad;
- Obtaining evidence abroad (outside and within the EU);
- Actual or potential relationship with other legal proceedings in the same or similar claim (e. g. forum non conveniens, anti-suit injunctions, lis alibi pendens);
- Transnational provisional relief;
- Recognition and enforcement of foreign countries judgments.
