Obiettivi formativi
Obiettivo del seminario è fornire agli studenti le conoscenze e gli elementi formativi di base della produzione di norme giuridiche a mezzo del c.d. "legal design" e della loro applicazione al fine di guidare i paesi verso la transizione verde, la neutralità carbonica e gli obiettivi di sostenibilità ambientale prefissati dal Green Deal europeo.The aim of the seminar is to provide students with the basic knowledge and elements of the production of legal norms through the so-called "legal design" and its application in the environmental law field with the purpose to drive countries towards the green transition, carbon neutrality and the environmental sustainability objectives set by the European Green Deal.

All'esito di questo insegnamento gli studenti dovranno dimostrare di padroneggiare gli strumenti di regolamentazione e il concetto di legal design come metodo di normazione, disambiguandolo dagli usi concorrenti del termine design in area giuridica;CAPACITÀ DI APPLICARE CONOSCENZA E COMPRENSIONE

Programma
I cambiamenti climatici e il degrado ambientale costituiscono una minaccia enorme per l'Europa e per il mondo. Per superare queste sfide, l’Unione Europea ha avviato un “patto per il clima” che necessita ora di trasformarsi da mero impegno politico in un obbligo giuridico cogente per gli Stati Membri e i loro consociati. Non si tratta solo di imporre norme di comportamento, ma anche e soprattutto di introdurre nuovi standard produttivi, che rendano i prodotti e i processi più rispettosi dell’ambiente, nonché di incentivare scelte di consumo virtuose, ad esempio attraverso etichette energetiche che aiutino a scegliere prodotti più efficienti. In questo scenario la tecnica tradizionale del diritto imperniata sulla minaccia di sanzioni o misure coercitive si appalesa sempre meno efficacie, mentre si va via via radicando l’idea che occorra sempre più governare tramite il “design”, ovvero plasmando la forma di prodotti e processi, così come la struttura di spazi e luoghi e il contenuto di informazioni e comunicazioni, al fine di ottenere le prestazioni desiderate o risultati predeterminati in termini ad esempio di riduzione dell’impronta carbonica o in quanto a durabilità e riparabilità dei prodotti. Il seminario si preoccupa di indagare proprio il rapporto tra design giuridico e sostenibilità, con l’obiettivo di offrire agli studenti una panoramica di come il diritto, attraverso il design, possa contribuire in maniera decisiva a raggiungere gli obiettivi del Green Deal Europeo e dell’Accordo di Parigi. L’analisi sarà condotta individuando le principali iniziative legislative in essere o in divenire nel quadro del Green Deal e mappando gli interventi di design giuridico che vi si rintracciano all’interno.

10. Lunedì 4 dicembreClimate change and environmental crisis pose a huge threat to Europe and the world. To overcome these challenges, the European Union has launched a “green deal” which now needs to be transformed from a mere political commitment into a binding legal obligation for Member States and their citizens. It is not just a matter of imposing rules of conduct, but also and above all of introducing new production standards, which make products and processes more respectful of the environment, as well as encouraging virtuous consumption choices, for example through energy labels that help to choose products more efficient. In this scenario, the traditional technique of law based on the threat of sanctions or coercive measures appears to be less and less effective, while the idea that it is increasingly necessary to govern "by design" is gradually taking central stage. This means try to shape the form of products and processes, as well as the structure of spaces and places and the content of information and communications so as to obtain the desired performances or predetermined results in terms, for example, of reducing the carbon footprint or strengthening durability and repairability of products. The seminar is concerned with investigating the relationship between legal design and sustainability, with the aim of providing students with an overview of how law, through design, can decisively contribute to achieve the objectives of the European Green Deal and the Paris Agreement. The analysis will be conducted by identifying the main legislative initiatives in progress within the framework of the Green Deal and mapping the forms of regulation by design that can be found within them.
