Obiettivi formativi
The Seminar is designed for students interested in Political Globalization and the role of Law as an instrument of Global Governance and/or Resistance, as well as in Law as the overall order of society governing in abstract terms the details of political and economical actions. The Seminar will afford also the so called 'New Approaches to Comparative Law', NACL, as a way to develop newer theories of sovereignty and governance in the future world order, where Law is not only a set of rules, but also one the most relevant symbolic aspect of global Soft-Power.The Seminar is designed for students interested in Political Globalization and the role of Law as an instrument of Global Governance and/or Resistance, as well as in Law as the overall order of society governing in abstract terms the details of political and economical actions. The goals of the course are to provide students with a critical understanding of the intellectual relationship between space and narrative in the framework of comparative analysis. The main issue is to problematize objectives and methods of comparative law with the aim to discover its strategic and subversive potentialities. The different classifications of the worldwide nomos into different families or systems - as one of the historical products of the macro-comparatistic discipline - will be re-investigated as the result of a decisionist act, supported by political and even economical arguments. On this ground the course will emphasize the subtle nexus between comparative law and geopolitics. In this persective the main issues discussed will be the following : introduction to the study of the key ideas in geopolitics ; models of geopolitical reflection (imperialist geopolitics ; classical geopolitics ; new world order geopolitics) ; the changing nature of contemporary geopolitics (critical geopolitics) ; the styles of thinking geopolitics and the styles of comparative law discourses ; the relationship between geo-economics and comparative 'law and economics' or 'law and finance'The goals of the course are to provide students with a critical understanding of the intellectual relationship between space and narrative in the framework of comparative analysis. ATTENZIONE: Annuncio per gli studenti che intendono inserire il corso di Diritto Comparato della Globalizzazione nel carico didattico.
Ai fini dello sviluppo ottimale delle abilità a cui il corso è diretto, a partire dall'anno accademico 2018/2019 la modalità "frequentanti" sarà limitata a 40 partecipanti. Gli aspiranti verranno selezionati all'inizio del corso sulla base della scrittura di un elaborato da presentare al docente entro la seconda settimana dall'inizio delle lezioni.
L'elaborato scritto dovrà essere di minimo 7.000 parole e dovrà essere inviato all'indirizzo mail: globalizzazione.diritto@gmail.com.
L'elaborato dovrà vertere su uno dei seguenti temi:
- Ruolo e funzioni della Banca Mondiale come attore globale
- Il destino della sovranità nel contesto globale
- Le tappe storiche della globalizzazione
Dall'elaborato dovranno emergere il particolare interesse per la materia trattata, lo spirito critico e la capacità di elaborazione delle fonti letterarie.
L'elaborato dovrà recare indicazione al fondo della bibliografia consultata.
La sottoposizione dell'elaborato è condizione necessaria per l'accesso alla modalità frequentante.
La valutazione dell'elaborato sarà comunicata la settimana successiva all'invio del paper.
