Obiettivi formativi
L'insegnamento intende fornire agli studenti e alle studentesse, attraverso una sistematica conoscenza del diritto romano e dei suoi valori, una capacità critica nei confronti di concetti e istituti giuridici di origine romana ancora oggi ampiamente presenti nel diritto privato italiano e europeo.
By means of a systematic knowledge of Roman law and its values, the course aims to provide students with a critical capacity in relation to legal concepts and institutions of Roman origin that are still widely present in Italian and European private law today.

Al termine dell'insegnamento gli studenti e le studentesse dovranno dimostrare di possedere le categorie fondamentali del diritto privato nella relativa dimensione storico-comparatistica, sviluppando altresì capacità argomentativa in relazione alla soluzione di casi prospettati nel corso della storia giuridica romana.
At the end of the course, students are expected to demonstrate their knowledge of the fundamental categories of private law in its comparative-historical dimension, and to develop argumentative skills in relation to the solution of cases arising in the course of Roman legal history.

La prima parte del Corso (I modulo) affronterà i seguenti temi:
- le fonti del diritto e il ruolo della giurisprudenza romana;
- il processo civile romano;
- la teoria generale del negozio giuridico;
- il diritto delle persone e della famiglia;
- il diritto della successione mortis causa.
La seconda parte del Corso (II modulo) affronterà i seguenti temi:
- i diritti reali e il possesso;
- le obbligazioni.
The first part of the Course (Module I) will deal with the following topics:
- sources of law and the role of Roman jurisprudence;
- Roman civil process;
- Legal transaction (general theory);
- law of persons and family law;
- law of succession mortis causa.
The second part of the Course (Module II) will deal with the following topics:
- property rights, rights in rem and possession;
- law of obligations.

L’insegnamento sarà svolto in aula in presenza. Il totale delle ore di lezione sarà pari a 60.

Modalità di verifica dell'apprendimento
L'esame si articola in prova scritta e prova orale. Il superamento della prova scritta è requisito di ammissione alla prova orale.
La prova scritta consiste nella formulazione di tre domande a tema sul programma d'esame da svolgere in un'ora di tempo. L'ammissione all'orale è stabilita con valutazione complessiva delle risposte, non espressa in trentesimi, di cui si terrà conto per la votazione finale.
La votazione finale sarà espressa in trentesimi.
The examination will be in written and oral form. Passing the written test requirement for admission to the oral test.
The written test will consist of three open questions, to complete in one hour. The admission to the oral test will be conditioned to passing written test.
Final votes will be given in 30 points.
