The educational targets of this course, as referred to the degree course in Global Law and Transnational Legal Studies, consist in: 1) providing students with the basic notions of Roman law, also with reference to the technical terminology connected to them, as a necessary basis for studying all law systems belonging to Roman law tradition; 2) introducing students to the understanding of law as a historical phenomenon subjected to modifications, hence to diachronic evolution; 3) with regard to the target mentioned under 2), introducing students to the juridical reasoning (with a main reference to civil law area) through examining the evolution of the institutes and of the systematic aspects of Roman law in the thoughts of the ancient jurists.

At the end of the course, students should be able to explain the basic notions of Roman law using the necessary technical terminology in a correct way; they should have acquired historical and juridical skills, so that they can explain the institutes of Roman law in their diachronic evolution; they should demonstrate to have understood and be able to express precisely the steps and stages of the process of juridical reasoning referring to each institute and to the systematic aspects of Roman law.

As the present Coronavirus pandemic is happily relenting, lectures will be regularly held in an in-presence modality, according to the ordinary timetable.

This course participates in the "Unita" project, which allows students belonging to foreign universities (all of them participating in the same project) to attend online courses belonging to other universitiies than their own. Therefore, lectures will be also streamed via webex at the following address: https://unito.webex.com/meet/lucia.zandrino. Video recordings of such lectures and also other teaching material (such as PDFs) will be uploaded on Moodle and available to all students. Unita students can contact by email both Professor Zandrino (for necessities connected to this course) and our offices at unita@unito.it (for general issues about Unita project). 

All students are in any case kindly asked to register to the course and also to register in the Moodle section, as this is needed in order to receive emails regarding the course (e.g. regarding meetings, teaching material, exams, etc).

Lectures and meetings do not replace the studying of the textbook, as they will usually cover only the most relevant aspects of Roman law. Nonetheless, students are highly encouraged to attend lectures, as these will be very useful for the understanding of the many technicalities of this subject-matter.

UPDATE SEPTEMBER 1st

The Moodle page has been activated today. Students are kindly invited to enroll. Lectures will start on September 26th, 2022. Lectures timetable is available at the bottom of this webpage (button "Orario lezioni")

Exams will be in presence starting from the winter calls (December 2022).

In-presence exams 

Exams will be only in written form and in in-presence modality. Students will be given an hour to complete a paper divided in three sections, as following: in the first section, students must answer to a multiple choice test with three questions; in the second section, students must focus only on a definition, list etc. pertaining to a Roman specific juridical institute (e.g. list of the modes of creation of usufruct; definition of 'mandate'; etc.); in the third section, students will be asked for an in-depth explanation of a Roman juridical institute. 

UNITA students will take their exam in online modality.

According to present regulations, non-UNITA students can request to be examined online only if they have Covid or other Covid-related health issues. In such cases, modalities of exam will be as following:

Online exams

Exams will be divided in two parts. The first part consists in a text with multiple choice, which will be accessible on Moodle. It consists of 20 (twenty) questions, to be answered in 20 minutes. Every right answer will receive 1 point. Questions will concern every part of the course except the law of obligations.

A minimum of 12 (twelve) points will be needed in order to access the second part of the exam, which is only oral. Students are examined online in the webex room of Professor Zandrino (https://unito.webex.com/meet/lucia.zandrino). Questions will concern only the law of obligation. 

As the modalities of the examination could change because of the sudden coming back of a Coronavirus emergency, please consult regularly this webpage for further updates.

This course offers a wide survey, with a both systematic and historical approach, of the Roman private and procedural law, hemphasising its development from the monarchic period till the Justinian age. Lectures will regard the following thematic sectors: 

1) sources of law;

2) law of actions (procedure);

3) law of persons;

4) law of property;

5) law of obligations.

Please take into account that the law of inheritance and the European ius commune are excluded from this course (see under in the textbook section)

Please refer to teaching material uploaded on Moodle for what concerns the part of the course concerning the law of actions and the extinction of obligations (see under in the textbook section). Other teaching material could be uploaded during the course. 

Please notice that part III, chap. 8 (law of inheritance) and part V as a whole of the above mentioned textbook are excluded from this course

Teaching material regarding the law of actions (procedure) and the extinction of obligation will be uploaded on Moodle and considered as obligatory part of this course.
