L'insegnamento si prefigge il raggiungimento di una valida padronanza concettuale e critica delle principali teorie, passate e contemporanee, del diritto pubblico, con riferimento alla realtà nazionale, sovranazionale e internazionale.

The course unit provides a good knowledge of the most significant theories on social, political and legal order in both historical and conceptual perspective. Furthermore, it aims at developing an in-depth understanding of the most influential contemporary contributions made by political and legal scholarship as regards the reshaping of the theoretical structure of public and private law, as well as of political and legal philosophy, as a result of globalization. Finally, the course unit aims at providing the students with a robust conceptual framework that should enable them to locate and better understand present and future developments in the field of political and legal theory.

L'insegnamento mira ad accrescere in modo specifico conoscenza e capacità di comprensione, autonomia di giudizio, abilità comunicative e capacità di apprendere.

Upon completion of the unit, students will be able to:

-    identify the most significant characteristics of the main strands of political and legal thinking as regards the understanding of the features of a "well-ordered society";

-    understand and analyze texts of political and legal theory with reference to the topics of the course unit (see: infra, VIII.);

-    employ a set of key terms and definitions that are essential to the study of political and legal theory;

-    present and discuss the above mentioned texts;

-    critically assess the different positions on how a "well-ordered society" should be organized;

-    write an essay on the topics of the course unit.

Modalità di insegnamento

L'insegnamento comprende, oltre alla classica lezione frontale, ampi spazi riservati alla discussione.

After the introduction, in which the conceptual framework of the analysis is presented, a participatory teaching method is applied, in which the students are requested to present the texts respectively selected for discussion and analysis and to take part in the critical assessment of their contents.

The different teaching blocks will be organised through a blend of different components: reading and study materials, video lectures, presentations with vocal comment, in presence or virtual room sessions (Webex) for interaction with students, assignments of reaction papers, students’ in presence or online presentations, etc.

A more precise organization of the course unit – which is still partially depending on the evolution of the restrictions related to the Covid-19 pandemic – will be communicated to the students before the beginning of the course unit.

All the materials are already available on Campusnet, while the Moodle platform will be essentially used to activate discussions and fora. It is therefore essential and compulsory that all students enrol in the teaching platforms (both Campusnet and Moodle) to have full access both to materials, discussions and communications.

L'esame prevede: a) la stesura di una tesina su un tema scelto tra gli argomenti trattati a lezione; b) la presentazione orale di uno dei materiali discussi durante l'insegnamento e scaricabili dal sito; c) la partecipazione attiva alla parte seminariale dell'insegnamento.

The assessment is based on

a) a short essay on a selected topic;

b) the oral presentation of one or more of the topics of the course unit;

L'insegnamento approfondisce gli effetti dell'integrazione sovranazionale, in particolare, e della globalizzazione, più in generale, sulla recente teoria del diritto pubblico e sulla dottrina dello stato in particolare. Integrazione sovranazionale e globalizzazione, con la conseguente necessità di dare maggior ordine a sempre più strette interazioni politiche ed economiche che superano le frontiere dello stato nazionale, hanno infatti indotto la dottrina a proporre un'estensione di categorie del diritto pubblico statale alla sfera extrastatale. In tal modo si è cercato di spiegare fenomeni quali il diritto amministrativo globale, la governance transnazionale e le ricadute normative dei processi di integrazione continentali. In forma ancor più ambiziosa si è tentato, sulla stessa via, di costruire il progetto di un ordine giuridico globale in grado di garantire la tutela vincolante della pace e dei diritti fondamentali. In tal senso, nella misura in cui gli individui e non più soltanto gli stati diventano i destinatari di un ampio riordino del sistema giuridico globale, l'estensione dei compiti del diritto pubblico statale al di là delle frontiere dello stato nazionale corrisponde alla ripresa dell'antica ipotesi di un diritto pubblico cosmopolitico. Il compito del corso nel suo complesso consiste dunque nel presentare i paradigmi della dottrina dello stato e del diritto pubblico, come si sono evoluti nella storia e in relazione alla loro capacità di elaborare una risposta teorica alle sfide del mondo contemporaneo. L'analisi dei paradigmi prenderà l'avvio dalla concezione dell'ordine politico nell'antichità, per approdare - dopo essere passati attraverso medioevo e modernità - alle più recenti costruzioni teoriche, dalla teoria dei sistemi alla critica postmoderna, dal superamento del pubblico nell'ipotesi dell'ordine spontaneo di attori privati al recupero della dimensione classicamente pubblica di legittimità e normatività nel paradigma comunicativo.

No social life is possible without order. Order being the most constituent element of society, it is not surprising that so many theories have been developed to explain what social order is and how it is possible, as well as to explore the features that social order acquires in its different dimensions. This course unit presents, first, the most significant understandings of social, political and legal order that have been elaborated and established in the past. To that purpose, the vast field of the many theories of social, political and legal order is led back to a few main matrices for the use of theoretical and practical reason, which are defined as "paradigms of order". On that basis, the plurality of conceptual constructs regarding social order is reduced to a manageable number of theoretical patterns and an intellectual map is produced in which, in an almost synoptic way, the most significant differences between paradigms are clearly outlined. Furthermore, the course unit addresses the "paradigmatic revolutions" that marked in past centuries - and are still marking in our time - the most relevant turning points in the way a "well-ordered society" is understood. Against this background, the course unit concentrates then, in a second step, on how the growing number of transactions beyond the borders of the nation states, identified by the concepts of globalization and supranational continental integration, has been addressed by political and legal theorists, with particular reference to the interpretations elaborated by the public law scholarship. In general, the challenges of the 21st century have been met by the leading public law scholarship through an extension of the domestic public law categories to the international domain, as well as through the introduction of new categories encompassing both the domestic, the supranational and the international level of public law. More specifically, the course unit presents, in the light of an in-depth analysis of many of the most influential recent contributions, how these strategies are leading to a redefinition of the traditional "paradigms of order", or even trigger a new paradigmatic revolution in the theories of order. As a result, well-established concepts, like sovereignty, national identity and constitutionalism are reshaped, while entirely new notions - such as lex mercatoria, global governance, global administrative law, or legal pluralism - are introduced. According to the most radical interpretation, even the positive value of the Western idea of order is utterly denied.

Lessons of the First Semester of ELS Master Program (1 st and 2 nd year) start on September 28th. Class schedules (weekly grid) will be out soon, both on the App MyUnitTO+ and on the ELS website. All courses will be ‘blended’, combining live webex lessons or Q&A meetings and online digital learning based on reading materials, presentations, tests, assignments etc.
Students have already access to the general syllabus (Dellavalle - Paradigms of National and International Order - Syllabus) as well as to learning materials and resources of the course unit on Paradigms of National and International Order through the Campusnet platform. The Moodle platform will be then activated at the beginning of the teaching time in order to guarantee the best conditions for communication and interaction between students and teacher. It is therefore essential for every student to enrol in both teaching platforms.
While the file "Dellavalle - Paradigms of National and International Order - Syllabus" contains a general information on the course unit, more precise instructions about the organization of the course unit – and, in particular, about the actual schedule, as well as the forms of interaction/participation and the assessment method under the modified conditions imposed by the restrictions due to the pandemic – will be uploaded under "Materiali didattici 2020/2021" shortly before the beginning of the teaching time. Therefore, to keep contact with the teacher and to be timely informed about the novelties, students should have a look, on a regular basis, at the website of the course unit, especially the "Avvisi" and the "Materiali didattici".
