Obiettivi formativi
Building upon the anthropological foundations presented in the first module, this second part of the course deepens the legal analysis of how human societies have historically organized themselves. It places particular emphasis on the influence that oral and written traditions have exerted in shaping legal systems. The module explores the diverse sources of law, considering their multiplicity and historical variability, while also addressing the question of legitimacy and how norms acquire authority across different contexts. Furthermore, it examines the relativity of legal structures in relation to time and space, highlighting how cultural frameworks condition the development and interpretation of law. Through this approach, students are encouraged to reflect on law not as a fixed set of rules, but as a dynamic cultural construct shaped by human experience.

The second module of the programme is designed to deepen students’ knowledge and understanding of law as a culturally embedded phenomenon, shaped by the diversity of human civilisations. By analysing legal systems through the lens of anthropology, students will learn to apply their knowledge and understanding to interpret the complexity of legal frameworks in multicultural and globalised societies.
Through the study of oral and written legal traditions and the variability of legal sources, students will be encouraged to form independent judgments, especially when confronted with legal solutions that differ from the Western model. The module promotes a non-judgmental and critical attitude, fostering reflection on the legitimacy and relativity of norms across time and space.
Students will also develop communication skills by articulating legal concepts clearly and effectively, both in academic contexts and in intercultural dialogue. Finally, the module supports learning skills by encouraging autonomous study and the ability to engage with unfamiliar legal systems.

Attending students can prepare for the legal form examination by using the notes taken in class. Some additional material may be shared in class. The examination will take the form of a written paper.
Non-attending students are required to prepare for the Legal Form examination by reading Law as Culture by Lawrence Rosen. The assessment will take the form of an oral exam.
