Welcome to "Platforms and the Law" (2024-2025)!

Dear Students,

I’m delighted to welcome you to this year’s course on Platforms and the Law, where we will explore the rapidly evolving legal landscape of the digital economy, with a special focus on the Digital Services Act (DSA)The course is thus focused on the analysis of the new EU Digital Services Act: The Digital Services Act ('DSA'): Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market For Digital Services and amending Directive 2000/31/EC, http://data.europa.eu/eli/reg/2022/2065/oj

In an era where online platforms shape not only markets but also our public discourse and fundamental rights, understanding the legal frameworks governing them is more important than ever. Throughout this course, we will analyse the opportunities and challenges of platform regulation, the enforcement mechanisms of the DSA, and its interaction with consumer protection, competition law, and fundamental rights.

Our discussions will be both theoretical and practical, drawing on real-world case studies, policy debates, and recent enforcement actions. I encourage you to bring your curiosity, critical thinking, and diverse perspectives in our classroom.

The learning outcomes for students could include:

  1. Understanding the EU Digital Services Act: Students will gain a comprehensive understanding of the DSA, its objectives, and its implications for the digital economy. This includes the regulation's structure, key provisions, and how it differs from or amends previous directives.

  2. Analysing B2B and B2C Contracting: Students will learn to analyze contractual relationships in both B2B (business-to-business) and B2C (business-to-consumer) contexts within the digital economy. They will explore how the DSA affects these relationships, including liability issues, consumer protection, and transparency requirements.

  3. Assessing Platform Liability and Responsibilities: Students will examine the responsibilities and liabilities of digital platforms under the DSA. This includes understanding the obligations imposed on intermediaries and platforms regarding content moderation, user protection, and compliance.

  4. Evaluating the Impact on Businesses and Consumers: Students will be able to assess how the DSA impacts both businesses operating digital platforms and the consumers using these services. They will consider how the DSA aims to balance innovation, competition, and consumer rights.

  5. Navigating Digital Contracting in Practice: Students will learn how to apply the principles and regulations of the DSA to real-world contracting scenarios. This includes drafting, negotiating, and enforcing contracts in a manner compliant with the DSA.

  6. Engaging with Current Debates: Students will be encouraged to engage with current debates surrounding digital services regulation, including issues of privacy, data protection, freedom of expression, and market competition. They will critically evaluate the effectiveness and potential shortcomings of the DSA.

The lectures will actively involve participants in debates between professors and students on the topics of the course, beyond the merely “frontal teaching”, and stimulating a dynamic approach to the topics

The final examination for this course will be a written assessment consisting of two open-ended questions in 90 minutes. These questions will require students to demonstrate a deep understanding of the legal issues related to contracts and the digital economy, particularly in the context of the EU Digital Services Act.
