Obiettivi formativi

The course aims at preparing students to solve new, real-life legal cases submitted by innovative businesses.

Students will learn to work in small groups to: understand a client's legal needs, by asking the appropriate question during a meeting with them; perform research on the case; write a legal opinion analysing the case; present the result of their analysis to a client. They will also acquire the basics of lawyers' professional duties (starting from protecting confidentiality) and of how to structure a legal opinion.

Topics involved typically involve tech-law related issues such as data protection, blockchain, platforms, artificial intelligence, and so on.

Real-life businesses submit to the laboratory's advisory committee a legal issue that they need to solve. The students, working in groups and under the supervision of expert lawyers and academics, study the case and present a legal analysis tailored to the needs of the business involved. This offers some very valuable training to students for their future professional lives.

The course also aims to initiate students in the use of one or more legal databases for the retrieval of regulatory sources, case law and doctrinal materials, as well as in the analysis of concrete legal cases to develop their argumentative skills, and finally in the production of short legal texts (legal opinions or briefs). These activities are part of a training programme aimed at providing each student with useful skills to develop the ability to interpret and apply the law, required by the world of professions.

The students will acquire experience in the treatment and practical resolution of real cases under the supervision of academics and experienced professionals. This will help them in their future professional lives, by providing them with some relevant experience in the analysis and resolution of legal questions submitted by businesses.

They will work in groups but their efforts will be evaluated individually. Professionals supervising them guide them but the analysis is performed by the students. There is not necessarily one single right answer to the cases submitted: all solutions presented by the students' independent may be valid if they derive from their independent approach and critical thinking.

Programma

Lectures will start on Thursday, 22 February 2024, from 12.00 to 14.00 in room H8 at Campus Luigi Einaudi (CLE). Lectures will be regularly held on Thursday and Friday in the same room and according to the same schedule (H8, 12.00-14.00).

The course begins with some introductory classes on the cases assigned and the main legal questions they raise. After that, students are divided into groups and assigned to an expert supervisor and to a local business that submits a legal question that they are currently facing.

Typically, students meet with their assigned tutor, then with the entrepreneur/startup a first time, then work on the solution of the case under the supervision of their tutor, prepare a short written text to explain their solution, and then present their legal analysis to the entrepreneur/startup.

Finally, a de-briefing seminar is held at the very end to exchange ideas and provide useful feedback on the activity.

Modalità di insegnamento

After a few mandatory initial classes presenting the cases assigned and some fundamental elements on how to handle confidential information and draft a legal opinion, the course is based on experiential learning. Students are divided into groups, supervised by a qualified legal professonal, and a real-life practical case (proposed by a business active in the territory, that such business is currently facing) is assigned to each group. Students, under the guide of the group's tutor, have to formulate a legal analysis/solution to the case.

Students are graded according to the quality of their individual participation, involvement and contribution to the final product of their group, principally based on the feedback from their assigned tutor.
