Poiché l'insegnamento risulta essere un approfondimento di alcuni profili dell'ordinamento costituzionale italiano, presuppone la conoscenza delle altre parti di quell'assetto (a titolo esemplificativo, gli organi costituzionali, le fonti del diritto, la pubblica amministrazione, la Corte Costituzionale e la giustizia costituzionale). Si consiglia dunque di intraprendere lo studio della materia e la frequenza dell'insegnamento solo dopo aver sostenuto l'esame di Diritto costituzionale I.
L’insegnamento è attivo a partire dall’a.a. 2021/2022 e può essere inserito nel piano di studi come materia “a scelta” (dal II anno del Corso di studi) oppure come materia “di ambito” (dal IV anno del Corso di studi).
Since the teaching turns out to be an in-depth study of some profiles of the Italian constitutional system, it presupposes knowledge of the other parts of that structure (by way of example, the constitutional bodies, the sources of law, the public administration, the Constitutional Court and the constitutional justice). It is therefore advisable to undertake the study of the subject and the frequency of teaching only after having taken the exam in Constitutional Law I.
The teaching is active starting from the academic year 2021/2022 and can be included in the study plan as a "choice" subject (from the second year of the study program) or as a "field" subject (from the fourth year of the study program).

Obiettivi formativi
Obiettivo dell'insegnamento è consentire agli/alle studenti/esse di comprendere le caratteristiche fondamentali dello Stato italiano quale ordinamento decentrato, mettendone in rilievo, grazie anche al contributo della giurisprudenza della Corte Costituzionale, i principali nodi problematici e interpretativi che attualmente lo connotano, relativi, in particolare, ai rapporti tra lo Stato e le Regioni, alla ripartizione di competenze in materia ambientale e paesaggistica e all'attuazione delle relative politiche ed obiettivi di tutela.
The aim of the course is to allow students to understand the fundamental characteristics of the Italian state as a decentralized system, highlighting, thanks also to the contribution of the jurisprudence of the Constitutional Court, the main problematic and interpretative issues that currently characterize it, relating, in particular, to relations between the State and the Regions, the division of competences in the field of environmental and landscape protection and the implementation of related policies objectives of protection.

Risultati dell'apprendimento attesi
Al termine dell'insegnamento gli/le studenti/esse acquisiranno: capacità di analisi dell'evoluzione del sistema costituzionale delle autonomie territoriali; capacità di approfondimento delle tematiche giuridiche in materia di rapporti Stato-Regioni-enti locali, con particolare riguardo alla materia della tutela dell'ambiente e del paesaggio; capacità di padroneggiare meccanismi di funzionamento e di decisione delle Regioni; capacità di analisi dei problemi giuridici relativi al riparto di competenze tra i diversi livelli territoriali in materia di tutela dell'ambiente e del paesaggio; capacità di valutazione critica dell'attuazione delle politiche ambientali da parte dello Stato e delle Regioni, anche nel quadro dell'obiettivo dello sviluppo sostenibile.
At the end of the course students will acquire: the ability to analyze the evolution of the constitutional system of territorial autonomies; ability to investigate legal issues relating to State-Regions-local authorities relations, with particular regard to the matter of environmental and landscape protection; ability to master the functioning and decision-making mechanisms of the Regions; ability to analyze legal problems relating to the division of competences between the different territorial levels in the field of environmental and landscape protection; ability to critically evaluate the implementation of environmental policies by the State and the Regions, also within the framework of the objective of sustainable development.

Insegnamento a distanza, salvo tre lezioni che saranno svolte in aula in presenza (registrate e pubblicate sulla piattaforma Moodle). Il materiale didattico è costituito da risorse moodle, che dovranno essere studiate settimanalmente. Modalità di verifica dell'apprendimento
Esame in forma scritta (con due domande “aperte”), sia per gli studenti frequentanti che per i non frequentanti, secondo modalità che verranno comunicate nella Pagina on line dell’insegnamento e sulla piattaforma Moodle.
Le modalità con le quali lo/a studente/ssa strutturerà le risposte, così come la padronanza dei concetti e il livello di approfondimento dell'argomento, consentiranno ai docenti di valutare se, e in quale misura, siano stati raggiunti gli obiettivi formativi del corso.
The exam will be written (with two "open" questions), both for attending students and non-attending students, according to modalities that will be communicated on the online teaching page and on the Moodle platform.
The ways in which the student will structure the answers, as well as the mastery of the concepts and the level of depth of the topic, will allow teachers to evaluate whether, and to what extent, the training objectives of the course have been achieved.
