Obiettivi formativi
The aim of the course is to introduce students to an adequate knowledge of the notion of criminal proceedings and of the principles that characterize it from an European perspective.

At the end of the course students will be asked to:
- demonstrate an appropriate knowledge of principles of the criminal proceedings and of the european criminal procedural law;
- understand and use properly legal therminology related to criminal procedure;
- be able to relate the concepts learned to practical cases.

Programma
After an introduction to the criminal procedural law (legal families, scope of criminal trial, adversarial systems), the focus will be on:
- parties and judges: roles, powers, duties;
- legal sources of the criminal procedural law;
- right to process, rights in the process, in the perspective of ECtHR case-law and EU law;
- mutual legal assistance in the European Union;
- current procedural issues: mutual recognition; transborder investigation; transborder evidence gathering; e-evidence; transfer of prisoners.

Modalità di insegnamento
European Criminal Procedure is an online course, held in a special Moodle platform. For each week of the course (six weeks), a virtual box containing learning materials – such as slides, videos, readings and self-evaluation quizzes – will appear in the Moodle platform homepage. Self-evaluation quizzes will be available from Thursday to the next Monday (the day before the opening of the new box).
Those who carry out at least four weekly quizzes with a minimum score of 18/30 are considered attending students. For the attending students, the score obtained in the final exam (if positive, at least 18) will be increased according to the average of the four better grades scored in the weekly tests, on the basis of the following criteria: average from 26 to 28 →1 point; average from 29 to 30 → 2 points.
A few days before the beginning of the course, students enrolled in the course page will receive instructions to join the Moodle Platform. Registration on the course page is therefore highly recommended in order to join the Moodle Platform.

The exam will consist of a written test composed of fifteen multiple-choice questions and one open-ended question.
Questions will be based on the learning materials stored in the Moodle Platform.
For the attending students, the score obtained in the final exam (if positive, al least 18) will be eventually increased according to the average of the four better grades scored in the weekly tests, on the basis of the following criteria: average from 26 to 28 →1 point; average from 29 to 30 → 2 points.
