Obiettivi formativi

The aim of the course is to introduce the students to an adequate knowledge of the notion of criminal proceedings and the basic principles of it, from a European perspective.

At the end of the course the students will be asked to:

- demonstrate an appropriate knowledge of principles of the criminal proceedings and of the european criminal procedural law;

- understand and use properly legal therminology related to criminal procedure;

- be able to relate the concepts learned to practical cases.

Programma

After an introduction to criminal procedural law (legal families, scope of criminal trial, adversarial systems), the focus will be on:

- parties and judges: roles, powers, duties;

- legal sources of criminal procedural law;

- right to process, rights in the process, in the perspective of ECtHR case-law and EU law;

- mutual legal assistance in the European Union;

- current procedural issues: mutual recognition; transborder investigation; transborder evidence gathering; e-evidence.

All students, regardless of the first letter of their surname, can choose to attend this in course or the course of European Criminal Procedure held by Proff. Scomparin and Cabiale.

Methods: traditional lecturing and socratic approach, with the analysis of practical cases and writing of memoirs.

Modalità di verifica dell'apprendimento

The exam will consist of a written test composed of fifteen multiple-choice questions and one open-ended question, IN PERSON. The exam will cover the topics addressed during the course and in the Chapters of the book Cambridge Companion to European Criminal Law 2023.

Randomly, there will be two in-class tests: students who will pass both, with at least 22/30 each, will get +2 points at the final exam.
